Sales Conditions
1. Our quotations, sales and undertakings are governed by the following conditions. We expect these conditions as known and accepted by the other contracting partner.The customer accepts them with the sign and stamp on our internal form at the moment of the registration of the company in the Easy Holland database.The following are only the general conditions.
2. Easy Holland sends own offers by email, or chat, with inside all the details about the same.On demand, only for the registered customers, it may search particular goods or special prices.
3. At the order, confirmed from the customer, Easy Holland will send own confirm over it by the proforma invoice, by the which blocks the price , the products, and indicates the final destination of delivery.Only after the payment and the delivery Easy Holland will send the real invoice about the sale.
4. The estimated delivery date is always mentioned as an indication but time shall not be of the essence. Delivery dates are therefore not guaranteed against every unexpected event.Delay in delivery can never be a motive for cancelling an order, especially if it depends from other parts, as, for example, the service offered from the carriers: if the forwarder has some delay to delivery the goods, every dispute is imputable to them or to other or third parts, or to other possible events, if it doesn't depend directly from Easy Holland.
5. Goods travel to our risk, as the following details : every our shipment is covered from our insurance policy against damages , thefts, or other disasters.Every refund depends from checks, times and requests of the insurance company.In case of some of these events, is obligation of the customer to show copy of the carrier's paper about the pick up with reserve and the reason, and photos of the goods and boxes at the arrival.
6. In case of factory disturbance, stoppage of operations, strikes or lock-out, force majeure, coincidence and/or government measures, we are relieved of our obligation to deliver and/or to execute.
7. The indicated price is the price valid on the day of the placement of the order. At the order Easy Holland blocks and confirms the price, by the proforma invoice.If between the date upon which an order is placed and the date of delivery an increase or decrease of the price might occur , is valid the price of the proforma invoice sent to the customer.
8. Possible complaints, remarks, contestations or protests are inadmissible if they are not formulated by registered letter within the five days after delivery and by email 1 day after the delivery. No returning of goods will be accepted without our prior permission. The other contracting party shall be responsible for all costs and expenses associated with the return. The customer can never use complaints of remarks as an excuse to suspend payment.
9. The contracting part must inspect goods immediately and thoroughly on delivery. All non-conformities or deficiencies must be notified as specified in article 8 of these conditions. If the other contracting part fails to give such notice the goods shall be conclusively and definitively presumed to be in accordance with the contract and free from any defect which would be apparent on thorough examination and the purchaser shall be deemed to have accepted the goods accordingly.
10. In case of delays, stoppage of operations, renunciations about the order already confirmed caused from the customer, the client will be considered liable for every economic or material damage happened to EasyHolland, which will have the right to charge the possible costs or refunds of the damage at the client.
11. Every order confirmed is a supply contract.In case of stoppage of operations, or renunciations about the order allready confirmed caused from the customer, in absence of the total payment of the order, EasyHolland will apply a penalty to be paid equal to 20% of the total amount, beyond any single cost incurred, legal also.
12. For every controversy is competent the court of Netherlands.By the EasyHolland form of registration signed,every customer accepts all the clauses above specified, by entering into a legal contract.
